This Privacy Policy describes Our policies and procedures on the collection, use, and disclosure of Your information when You use the Service and tells You about Your privacy rights and how the law protects You.

It also includes data that can't directly identify you but can when combined with other accessible information, like product serial numbers, log data, unique device ID, and geo-location. 

• Account: Refers to a unique account created for you to access our Application or parts of our Application.

• Application: Refers to MySpy, the software program provided by us.

• Company: Refers to MySpy, also referred to as “We”, “Us”, or “Our” in this Agreement.

• Device: Refers to any device that can access the Application such as a computer, a cellphone, or a digital tablet.

• Personal Data: Any information that relates to an identified or identifiable individual.

• Service: Refers to the Application.

• Service Provider: Any natural or legal person who processes the data on behalf of the Company. This includes third-party companies or individuals employed by the Company to facilitate the Application, to provide the Application on behalf of the Company, to perform services related to the Application, or to assist the Company in analyzing how the Application is used.

• Usage Data: Refers to data collected automatically, either generated by the use of the Application or from the Application infrastructure itself (for example, the duration of a page visit).

• User/You: Refers to the individual accessing or using the Application, or the company, or other legal entity on behalf of which such individual is accessing or using the Application, as applicable.

To deliver MySpy Services, we gather and process your Personal Information. This information, which you voluntarily provide, is crucial for the provision of our services. If you choose not to provide your Personal Information, it may hinder our ability to deliver our Products or Services.

Here are some specifics about the information we collect:

• Account Creation Information: Before using Our Services for the first time, you need to provide information including your name, and phone number to create an account. This information will be stored until your Account is deleted.

• Product Information Collection: When you add, install, activate, and manage Products, we collect certain basic information such as your product name, the product’s verification code, serial number, and IP address.

• Surveillance Data Collection and Usage: Our application allows you to view and analyze surveillance data collected or recorded by the MySpy server software. This includes video (and occasionally audio) recordings, live feeds or streams, and still photos. We handle this information differently from other types of data. We will only access your Surveillance Information with your permission or if legally obligated to do so.

• Biometric Data Collection and Processing: To enhance the security features of our Application, we may collect and process biometric data, specifically facial images, to identify unknown individuals. Notably, these facial images are not stored on our servers but are retained on your devices. This feature is integral to the functionality of our Application and by using our Application, you agree to such collection and processing. 

• Video Preview Transmission: When you use MySpy Services to preview the video, we only transmit it, rather than store it.

• Video Playback Transmission: When you store video clips in your own SD card, hard disks, etc. of your own devices, you may use our playback function to view the video, in which case we only transmit your information, rather than store it.

• Alert Information Processing: When you use Our Services to receive pictures or videos as alert information, we process information from your Products so that we can send you alerts when something happens.

• Content Sharing Information Collection: When you save and share your content through Our Services for other individuals to access, we collect information to enable this functionality.

• Customer Support Interaction: When you respond to our e-mails, contact our customer service, or use other customer support tools, we collect your information to provide you with support.

• Usage Information Collection: When you access Our Services, we collect information related to how you use Our Products and Services.

How We Use Your Information

We may utilize your Personal Data for the following reasons:

• User Registration Management: We manage your registration as a user of the Service using the Personal Data you provide. This gives you access to various functionalities of the Service available to registered users.

• Promotions and Information: We may provide you with news, special offers, and general information about other goods, services, and events that we offer that are similar to those that you have already purchased or enquired about unless you have chosen not to receive such information.

• Business Transfers: We may use your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by us about our Service users is among the assets transferred.

We may collect information about you in a variety of ways. The information we may collect via the Application depends on the content and materials you use and includes: 

• Third-Party Service Provider Sharing: We do not engage in the sale of Personal Information to third parties. However, we may share your personal information with third-party service providers under the protection of a non-disclosure agreement. By using our services, you agree that we may disclose your personal information to our service providers. Our service providers assist us in processing, storing, and safeguarding some of your data, and in enhancing the user experience and the quality of our Products and Services. This third party is prohibited from utilizing your personal information for any purpose other than ours and is obligated to safeguard your information in compliance with this Privacy Policy and relevant laws.

Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to and maintained on computers located outside of Your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those from Your jurisdiction.

Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.

The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.

In accordance with relevant laws, you may have the right to (i) access specific personal data we hold about you, (ii) request that we rectify any inaccuracies in that data, (iii) express objections or restrictions to our usage of your personal data, and (iv) request us to erase your personal data from our database. We will respond to your request within 48 hours, as required by applicable laws. We may require a written request for security purposes. We will validate your identity as mandated by local laws. We reserve the right to refuse the request if we have reasonable grounds to suspect that the request is fraudulent, impractical, risk the privacy of others, would contravene any law or legal requirement, or would adversely affect the accuracy of the information. 

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, typically 7 days, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

We’ve put in place security measures, such as encryption and TLS technology, intending to protect your personal data against unintended loss and unauthorized access, use, modification, and disclosure.

However, it’s important to remember that the security of your information also relies on your vigilance. If we’ve provided you with a password, or if you’ve created one to access the App or certain features within it, you must keep this password confidential. We kindly request that you refrain from sharing your password with anyone.

Please be aware that, despite our best efforts, no transmission over the internet or mobile platforms can be guaranteed to be completely secure. While we strive to protect your personal information, we cannot ensure the absolute security of your personal information transmitted via the App. Any transmission of personal information is undertaken at your own risk. Please note that we are not liable for any bypassing of privacy settings or security measures within the App.

Detailed Information on the Processing of Your Personal Information

The Service Providers We use may have access to Your Personal Data. These third-party vendors collect, store, use, process, and transfer information about Your activity on Our Service in accordance with their Privacy Policies. We do not share any personally identifiable information with any third party. 

Analytics

• Google Analytics: Google Analytics, a service provided by Google, tracks and reports on website traffic. The data gathered is used by Google to keep track of and analyze the usage of our Service. This information is also shared with other services provided by Google. The data collected may be used by Google to provide context and personalize the advertisements on its own advertising network. Usage, Performance, and Miscellaneous

• Google Crashlytics: To ensure a smooth user experience, we use third-party services like Google Crashlytics to analyze app performance and identify and fix technical issues. Google Crashlytics collects non-personal data, such as crash reports and device information, solely to enhance our app's performance. We do not share personal information with Google Crashlytics or any third party. Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.

If We need to rely on consent as a legal basis for processing Your information and Your country requires consent from a parent, We may require Your parent's consent before We collect and use that information.

Changes to this Privacy Policy

We hold the authority to alter this Policy at our discretion. Should there be significant changes to the Policy, we will inform you by providing an in-app alert during your first use of the App following the change. The date of the last revision of this Policy is indicated at the top of the page. All changes become effective immediately upon posting and apply to all subsequent access and use of the App. However, as required by law, we will seek your explicit consent before making significant changes to this Policy regarding the use or disclosure of personal information that we collected or received prior to the date of the change. Your continued use of the App after the posting of changes signifies your acceptance and agreement to the changes.
